According to a report from Yahoo, a civil sexual assault lawsuit has been filed against a hospital in Florida. HCA Florida Bayonet Point Hospital is facing a civil claim from a former patient who was allegedly sexually assaulted by a former nurse of the provider. The alleged perpetrator, 31-year-old Anthony Coleman, was arrested and criminally charged in May of 2025. Here, our West Palm Beach civil sexual assault attorney provides a more comprehensive overview of what we know about this case and the law.

Serious Allegations of Sexual Assault at a Florida Hospital

As confirmed by reporting from Yahoo, a civil lawsuit has been filed against HCA Florida Bayonet Point Hospital in Hudson, Florida. A former patient who alleges that she was sexually assaulted by a registered nurse during a hospital admission in May of 2025. Within the civil complaint, the patient alleges that the assaults occurred between May 11th of 2025 and May 20th of 2025. The accused former nurse, Anthony Coleman, was arrested by the Pasco Sheriff’s Office soon after the patient’s discharge. Mr. Coleman was reportedly charged with felony sexual battery, misdemeanor battery, and misdemeanor exposure of sexual organs. For its part, the hospital has denied tolerance for conduct that endangers patients and has stated that it is cooperating with law enforcement.

Civil Case is About Accountability and Compensation

For survivors, it is important to understand that a civil sexual assault lawsuit is different from a criminal prosecution. A criminal case is brought by the State of Florida and focuses on whether the accused person committed a crime. A civil case is brought by the survivor and focuses on accountability, financial compensation, and institutional responsibility. In a hospital setting, a civil claim may seek damages for trauma, emotional distress, medical expenses, counseling, physical injuries, loss of dignity, and other harm. A survivor does not need to wait for a criminal conviction to explore a civil claim. The standards, parties, deadlines, and available remedies are different.

Hospital Liability May Depend on Institutional Negligence

Patients put a tremendous amount of trust in the hands of a hospital. When they get care, they are, by definition, in an extremely vulnerable position. At the same time, a hospital is not automatically civilly liable for every intentional criminal act committed by an employee. However, a hospital may face liability if it fails to use reasonable care to protect a patient. In Florida, potential claims may include negligent hiring, negligent retention, negligent supervision, negligent security, premises liability, and failure to enforce patient-safety policies. Key questions may include whether the hospital properly screened the employee, responded to prior complaints, monitored access to vulnerable patients, enforced chaperone rules, supervised night or private-room interactions, and maintained adequate reporting systems. These cases often turn on what the hospital knew or should have known before the assault occurred.
