Filing a Civil Suit Against an Abuser in the Equestrian Industry: What Victims Need to Know

Victims of sexual abuse in the equestrian world face not only emotional trauma but, often uncertainty about their legal rights. In Florida, survivors can pursue civil lawsuits against their abusers, even if a criminal case is not filed or does not result in a conviction.
Under Florida Statute § 95.11(7), survivors of sexual battery have up to seven years after the incident, four years after leaving the dependency of the abuser, or four years after discovering that the abuse caused their injury- whichever occurs later. For cases involving victims under the age of 16, Florida law allows sexual battery charges to be filed at any time. However, this exception does not apply to cases that were already time-barred as of July 1, 2010.
Civil lawsuits can allow victims to seek compensation for emotional distress, medical costs, lost income, and pain and suffering. In some situations, Florida law also permits victims to pursue punitive damages as extra compensation intended to punish the abuser for particularly reckless or intentional conduct.
Importantly, survivors may also have claims against organizations, barns, or businesses that failed to properly supervise, investigate, or protect them. This could include negligent hiring or retention, especially when abuse occurs in trainer-rider or barn owner-employee relationships.
