Infant Killed in Tragic Rollover Accident in Broward County

According to a report from CBS 4 Miami, a one-year-old child was killed and six other people were injured in a tragic rollover accident in Broward County. A spokesperson for the Broward Sheriff’s Office told reporters that the rollover accident involved one vehicle, a Nissan Frontier truck. It occurred around 4:30 in the afternoon in the western part of the county.

No final determination has been made as to the cause of the rollover and the crash is still under investigation. Though, a preliminary assessment suggests that a blown out tire may have been a factor in the devastating accident. Our thoughts are with the families and everyone else affected by this heartbreaking tragedy.

Public Safety Issue: Rollover Accidents are Uniquely Dangerous 

While they are relatively uncommon, rollover crashes are extremely dangerous. A comprehensive analysis performed by the National Highway Traffic Safety Administration (NHTSA) found that rollovers account for a small percentage of total motor vehicle accidents reported in the United States. Yet, nearly one third of all passenger vehicle traffic fatalities happen in rollover collisions.

To put this data into perspective, the NHTSA estimates that rollovers are nearly 10 times more likely to result in a death than are other types of crashes that occur at a similar speed. When a vehicle rolls over, the consequences are often catastrophic. By doing more to prevent rollover accidents, we will prevent tragedies and save lives.

Vehicle Manufacturers May Be Responsible for a Rollover  

Similar to other car accident claims, all parties that contributed to a crash through carelessness or recklessness can be held accountable for the resulting damages. As rollover accidents are a known public safety hazard, vehicle manufacturers have a responsibility to protect consumers. While manufacturers are not in a position to prevent every rollover accident, they can make a dramatic difference. When a vehicle is well-designed and properly manufactured it will be:

  1. Less likely to roll over in a collision; and
  2. Better able to protect its occupants during a rollover crash.

In some cases, vehicle manufacturers may bear partial (or total) liability for rollover accident injuries. To bring a product liability claim against an automaker, a plaintiff must prove that the vehicle was defective. In other words, the vehicle must have been unreasonably dangerous. In rollover accident claims, plaintiffs must prove that the vehicle had an unacceptable propensity to roll over or inadequate rollover crash protection.
