Background: Miami Priest Committed Sexual Abuse for Decades
Father Neil Doherty is a retired Miami priest who has been accused of serial sexual abuse against minors. The allegations date back to the early 1970s and run through the early 2000s. Over two dozen men have filed claims against Father Doherty allegeding that he used his position of power to exploit them. They were reportedly offered gifts, alcohol, or drugs as a form of grooming. One victim’s lawsuit resulted in a $100 million jury verdict in the form of both compensatory damages and punitive damages. Notably, Father Doherty faces multiple criminal charges, including counts of sexual battery and lewd conduct with a child. There have been additional civil suits accusing the Archdiocese of Miami of failing to act on early complaints and of covering up misconduct.
New Civil Lawsuit Filed in Father Neil Doherty Sexual Abuse Case
A new civil lawsuit has been filed alleging that Father Neil Doherty sexually abused a former minor in Miami. The plaintiff, who says he was 15 at the time of the abuse, accuses Doherty of grooming him using money and substances and he also claims the Archdiocese of Miami failed to act on earlier warnings. The Archdiocese has released a statement noting that Doherty was removed from active ministry in 2002 and that it “reports any allegation of sexual abuse of a minor” to state authorities.
Is the Archdiocese of Miami Responsible for the Priest’s Sexual Misconduct?
The civil lawsuits that were filed by and on behalf of the victims allege that the Archdiocese of Miami does bear responsibility. From a legal perspective, the Archdiocese of Miami may be held responsible for Father Neil Doherty’s misconduct if they were at fault for negligent supervision, retention, or the failure to act on known risks.
Under Florida’s sexual assault laws, an institution can face civil liability when it knew or should have known that an employee or associate posed a danger and failed to take preventive measures. There are multiple civil lawsuits that allege that church officials received prior complaints about Doherty’s behavior yet allowed him continued access to minors. If proven, such inaction could constitute institutional negligence. Ultimately, liability will depend on evidence showing that the Archdiocese had actual or constructive knowledge of the misconduct and failed to act.
