North Florida Flooring Company Faces Civil Sexual Misconduct Lawsuit

Pike New

According to ABC 13 My Panhandle News, a flooring company in North Florida is facing a civil misconduct lawsuit. Renovation Flooring, a company based in Miramar Beach, has been sued by the Equal Employment Opportunity Commission (EEOC). Here, our West Palm Beach sexual assault and battery lawyer provides an overview of the allegations.

An Overview of the Allegations (Sexual Misconduct Allowed By Employer)

The EEOC has filed a federal suit against Renovation Flooring, LLC and its parent, Payfin Enterprises, LLC. The agency alleges that the company is responsible for a violation of Title VII of the Civil Rights Act due to a culture of through sexual harassment and unlawful retaliation. According to the complaint that was filed in a federal court in Florida, the owner and CEO subjected multiple female employees to a pattern of sexually hostile conduct. The alleged misconduct included explicit comments about body parts, propositions for sex, unwelcome physical touching, requests for sexual favors, and threats of termination for refusal to comply. The lawsuit against the North Florida companies seeks all available remedies including, back pay, compensatory damages, punitive damages, class relief, and injunctive measures to prevent sexual misconduct.

Employers May Be Liable for Sexual Harassment, Sexual Assault, and Other Misconduct

Companies can be held legally responsible when employees are subjected to sexual harassment, sexual assault, or other forms of workplace misconduct. Under federal law, including Title VII of the Civil Rights Act, employers have a duty to maintain a safe work environment. If supervisors or company leaders engage in harassment, or if management ignores credible complaints, the business may face liability. Victims may be entitled to compensation for lost wages, emotional harm, and other damages.

Of course, you do not have to be an employee to have a civil sexual misconduct claim against a business. Customers, clients, contractors, and even visitors can pursue civil legal action if they endured sexual harassment, sexual assault, or any other form of related misconduct on company premises. Businesses have a duty to provide a reasonably safe environment for all who enter. When that duty is breached, victims may recover damages in civil court.
