On March 10th, 2025, Local 10 News reported that a pedestrian was killed in a crash in Miami-Dade County. The incident—which is still under a more comprehensive investigation—reportedly involved a large commercial truck. Deadly Truck Accident in Northwest Miami-Dade County 

Unfortunately, a pedestrian was killed in a terrible accident in Miami-Dade County. As confirmed by law enforcement, the crash happened in northwest Miami-Dade, near the intersection of Northwest 27th Avenue and 46th Street. A semi-truck was involved in the accident. The trucker stayed at the scene and cooperated with police. The victim, a man, was pronounced dead at the scene by Miami-Dade Fire Rescue. The fatal pedestrian crash is still under a more comprehensive investigation by the Miami-Dade Sheriff’s Office.

Large Commercial Trucks Pose a Serious Safety Risk to Pedestrians 

A tractor trailer that is carrying a full load can weigh as much as 80,000 pounds in Florida. Due to their massive size, eighteen wheelers pose a major risk to pedestrians. Even a low speed truck/pedestrian crash can be catastrophic or deadly. Pedestrians are especially vulnerable.

 Florida has a Poor Pedestrian Safety Record 

Pedestrian safety is a major problem in Florida. Unfortunately, ​Florida has one of the highest pedestrian fatality rates in the entire country. In the first half of 2024, Florida, along with California and Texas, accounted for 35 percent of all pedestrian deaths nationwide, despite comprising only 28 percent of the U.S. population. To be clear, it is not just that Florida is a large state. According to the Governor’s Highway Safety Office (GSHO), Florida’s pedestrian fatality rate was the third highest nationwide in 2023. Only New Mexico and Louisiana had a less favorable pedestrian safety record.

 What to Know About Pedestrian Liability in Florida (Fault/No-Fault Laws)

 Florida’s no-fault law requires drivers to carry Personal Injury Protection (PIP) insurance. It is a type of no-fault coverage that covers medical expenses and lost wages regardless of who was at fault in an accident. Florida’s no-fault law applies to pedestrians who are struck by a vehicle. If a pedestrian is injured in a crash, they can file a PIP claim through their own auto insurance policy (if they have one). If the pedestrian does not have auto insurance, they may be covered by a household family member’s PIP policy. If neither the pedestrian nor anyone in their household has PIP coverage, they can file a claim against the driver’s PIP policy.

Note: For serious accidents, injured pedestrians can step outside of the state’s no-fault system and file a fault-based claim directly against a negligent truck driver or negligent truck company.
