What are liquidated damages?

Liquidated damages is also referred to as ascertained damages. These damages are the amounts the parties designate during the formation of a contract and damages that can be ascertained by documents like invoices. Unliquidated damages cannot be determined by operation of law. This is in the form of pain and suffering.
