In the State of Florida we’re governed by the Florida Bar. The Florida Bar says that we can charge 33 1/3 percent on a contingency, basis before an answer is filed to a law suit. Once an answer is filed to a law suit, then the attorney is entitled to charge 40% of a contingency. There is a sliding scale that all clients should be aware of after the first million dollars is recovered, but your lawyer should explain that to you specifically. Contingency fees are based on zero dollars paid by the client unless the attorney recovers. That is the basis of a contingency fee contract in the state of Florida.
