Depending upon the circumstance, your own insurance company may have committed bad faith in handling your claim. They may have received a timely demand letter and they may have opted not to pay policy limits. If that is the case, you could pursue a bad faith claim against your own insurance company. However if your own insurance company is deemed not to have committed bad faith, then you would be responsible for the excess verdict.
